A defendant shall be punished by imprisonment for one year.

However, the execution of a sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 24, 2016, the Defendant prepared a false complaint against C using a computer at the law office located in Jinju-si B.

The contents of the complaint are as follows: (a) at the office of F&C around January 27, 2015, the Defendant Nonparty entered the F&C’s Internet site and entered the “performance (Advance payment) guarantee insurance contract”; (b) entered the F&C’s “Insurance contractor” column into the “G” and “H” column; and (c) entered the insurance subscription amount column into the “60,000,000,000,” respectively; and (d) signed the respective electronic signature in the name of the complainant using a certified certificate issued by the complainant kept in the above office; and (e) sent the above performance (Advance payment) signature to F&C office; (e) made the performance (advance payment) at the same place on April 20, 2015; and (e) made the performance (advance payment); and (e) made the performance (advance payment); and (e) made the insurance subscription form in the same manner, and (e) made the insurance subscription form into the “Insurance column” column 0; and (e) made the said subscription form “E” column 00, “E”.

In addition, on July 22, 2016, the Defendant received a statement from the head of the police station affiliated with the above police station at the private police station investigation and the economic team office located in Scheon-si and 37 on July 22, 2016, and the Defendant prepared “the letter of subscription for guarantee insurance (advance payment)” by accessing the F company’s Internet site at the (State) E office located in Sacheon-si and around November 3, 2014, the Defendant entered “K” in the “insurance contractor” column, “K”, “K” in the insurance subscription amount column, and “50,000,000 won” in the insurance subscription amount column, and then, the Defendant made the electronic signature in the name of the complainant using the official certificate issued by the complainant kept in the above office (Advance payment).
