1. The plaintiff's primary and conjunctive claims against the defendants are all dismissed.

2. The costs of lawsuit are assessed against the Plaintiff.

1. Basic facts

A. The Plaintiff and Defendant Dongdong Co., Ltd. (hereinafter “Defendant Dongdong”) are companies for the purpose of drug wholesale business. C is a person who operated a pharmacy (hereinafter “E pharmacy”) under the trade name of “E pharmacy” in the building located in Seongdong-gu Seoul Metropolitan Government D, and Defendant A and B are those who acquired the business of the instant pharmacy.

B. The Plaintiff entered into a medicine supply contract with C around July 2, 2015, and supplied C with medicine from around that time to December 14, 2015. The amount of medicine related to the instant pharmacy that C did not pay to the Plaintiff is KRW 317,942,643.

C. 1) On December 31, 2015, C between Defendant A and Defendant B, as well as C, transfers the instant pharmacy’s business to the said Defendants at KRW 1.3 billion (hereinafter “instant business transfer agreement”).

(2) On January 11, 2016, C, Defendant A, and B concluded a contract under which the Defendants acquired KRW 459,021,830 of the pharmaceutical price payment obligation against Defendant Dong Dong-dong and paid it to Defendant Dong-dong in lieu of C, and exempted C from the obligation to pay the price under the instant contract for the transfer of business (hereinafter “instant contract to assume the obligation”) within the scope of that amount.

3) The Defendant A and B paid approximately KRW 1.3 billion by paying or accepting the debt of C as follows, including the assumption of the obligation of this case under Paragraph (2) of the same Article.
