1. The Defendants shall jointly and severally pay to the Plaintiff KRW 105,00,000 and the interest rate of KRW 15% per annum from January 31, 2017 to the date of full payment.
Reasons
1. On December 10, 2016, the Plaintiff entered into a sales contract with Defendant A on December 10, 2016, stipulating that the purchase price per household shall be KRW 110 million as to the D building Nos. 201, 202, and 202, located in the territory of North Korea, and each household purchase price shall be KRW 330 million in total.
On December 28, 2016, Defendant A paid 15 million won for the remainder of the purchase and sale under the above sales contract to the Plaintiff until January 30, 2017, but agreed to pay interest at the rate of 20% per annum. Defendant B guaranteed Defendant A’s obligation to pay the remainder of the purchase and sale.
The Plaintiff completed the registration of ownership transfer for the above three households on or around April 4, 2017 pursuant to the above sales contract, and thus, the Defendants are obliged to pay the remainder of sale and interest for delay pursuant to the above agreement.
