1. The Defendant’s KRW 271,040,220 as well as 5% per annum from January 10, 201 to May 19, 2016 to the Plaintiff.
Reasons
1. Establishment of liability for damages;
A. The establishment of liability: (a) On January 10, 201, 10:00, B driven a C chartered bus (hereinafter “AV”) and proceeded one-lane of the two-lanes in front of the E-Maart located in Ansan-si, E-ray D in Ansan-si; (b) at the intersection, the video is approaching the above road to board the vehicle and did not discover the Plaintiff who opened the door on board the said vehicle; and (c) sent the above vehicle to the front right-hand wheels with the Plaintiff with a shock, wave-type blood transfusion, multi-face large volume, organization damage, etc. (hereinafter “instant accident”); and (b) the Plaintiff used a melting vehicle as a part of usual transit; and (d) the Plaintiff did not have any dispute between the parties to a mutual aid agreement and the Defendant concluded a mutual aid agreement, taking into account the following facts: (a) there was no dispute between the parties to the mutual aid agreement and the Defendant: (b) there was no 10 meters prior to the passage of the above vehicle through the intersection; and (c) there was no dispute between the parties.
According to the above facts, if a driver B of a sea-going vehicle intends to make a right-hand side through the intersection, he/she shall, in advance, go through the right-hand side of the road, check the situation of the road and pedestrian, etc., and safely make a right-hand side. In particular, since the point at which the above accident occurred is near the passenger's getting on and off the crosswalk for the crosswalk and the commuting to the intersection, even though he/she has a duty of care to confirm whether there is a person approaching the above vehicle as the plaintiff, and the accident of this case occurred, the defendant is liable to compensate the plaintiff for the damages caused by the accident of this case as a mutual aid business operator of a sea-going vehicle.
B. On the other hand, as the plaintiff, the vehicle driving along the road which is unreasonable to get on a sea-going vehicle.
