1. The Defendant’s interest rate of KRW 76,926,486 and KRW 24,645,810 among the Plaintiff shall be from July 1, 2015 to the date of full payment.

1. Basic facts

A. Although the Defendant entered into a credit card transaction agreement or loan transaction agreement with seven financial institutions including Samsung Card Co., Ltd., the Defendant did not pay the principal and interest of the loan to each financial institution.

B. On May 13, 2005, the Plaintiff entered into an asset transfer contract with each of the above financial institutions and accordingly acquired the Defendant’s claim against each of the financial institutions. On June 16, 2005, pursuant to Article 7(1) of the Asset-Backed Securitization Act, the Plaintiff notified the Defendant of the transfer of claim as above by content-certified mail.

C. As of June 30, 2015, the amount of the principal and interest of the Defendant that the Plaintiff acquired from each financial institution, as of June 30, 2015, reaches a total of KRW 76,926,486 (= Principal KRW 24,645,810 or delay damages KRW 52,280,676) as indicated below.

On the other hand, after July 1, 2015, the overdue interest rate of each of the above gold-backed claims is 17% per annum.

2. Determination

A. According to the facts established prior to the determination of the cause of the claim, the Defendant is obligated to pay to the Plaintiff a total of KRW 76,926,486 (i.e., principal amount of KRW 24,645,810 or damages for delay interest of KRW 52,280,676) and damages for delay calculated at the rate of 17% per annum from July 1, 2015 to the date of full payment of the principal amount of KRW 24,645,810, which is the day following the date of calculating the claim.
