Punishment of the crime
피고인은 피해자 C(여, 18세)의 친부이고, 피해자는 지적장애 3급의 장애인으로 수년 전 피해자의 친모와 이혼한 이후 전북 순창군 D에서 피해자와 함께 거주하던 중, 2012년경 피해자가 이성과 성관계를 하였다는 소문을 듣고 피해자를 때리면서 ‘앞으로 누구라도 밖에서 성관계를 하고 들어오면 아빠와 성관계를 해야 한다.’라는 취지로 윽박지른 사실이 있었다.
1. 2. 2012. 10. 일자미상 08:00경 위 피고인의 집에서 고구마를 먹고 있던 피해자에게 “예전처럼 남자들을 만나러 다닌다는 소문이 있는데 사실이냐. 약속을 지키지 않았으니, 성관계를 해야 한다.”라고 윽박을 지르면서 파리채로 피해자의 몸을 수회 때린 후 위 1항과 같은 방법으로 피해자를 간음하였다.
