피고인은 2018. 11. 30. 03:07경 부산 해운대구 B에 있는 피고인의 주거지에서, 동네 이웃이던 피해자 C(55세)이 돈을 갚지 않는다는 이유로 화가 나 피고인의 휴대전화로 피해자에게 피해자의 집 현관 사진과 함께 ”오늘 저녁에 찾아가서 뺀찌로 니 잇빨부터 뽑니다. 그 잇빨도 우리돈으로 한거닌까 우리가 돈못받아서 뻔뻔한 사기꾼 니 잇빨부터 다 뽑는다. 오늘 저녁에 집에 있어라”라는 문자메세지를 전송하고, 2018. 12. 21. 공소장의 12. 20.은 오기로 보인다.

10:49경 위 같은 장소에서 피해자에게 “니놈 집구석에 가서 주먹으로 때리고 발로 차고 그 집에 돈 줄때까지 눌러 살아라고 깡패들 돈주고 시킬꺼다. 쥐놈을 쥐잡듯이 잡아 죽여버린다. 살려둘 가치 조차도 없는 쥐새끼 닌까 쥐새끼 한 마리 죽였으면 마을 사람들도 다 잘 죽였다고 좋아하고들 하겠지,ㅋ.ㅋ.ㅋ”라는 문자메시지를 전송하는 등 2회에 걸쳐 피해자를 협박하였다.
