피고인은 2013. 1. 16. 16:45경 대구 북구 B에 있는 C스포츠센터 주차장 입구에서 피고인의 다마스 차량이 주차장 입구를 막고 있어 피해자 D(52세)이 운전하는 25인승 버스가 그곳 주차장으로 들어가지 못하여 경음기를 울렸다는 이유로 버스에 타고 있던 위 스포츠센터 회원 20여명과 주위 주차관리원 E 등이 보는 앞에서 인근 은행에서 나오면서 피해자에게 삿대질을 하며 다가가 “씹할 것 크락숀을 그래 울리노, 씹할 개새끼야, 내 오늘 니 죽이삔다. 니 오늘 내한테 제대로 걸렸다. 죽이뿐다, 나이 처먹었으면 이새끼야 나이값을 하든지 운전은 못하면 임마 집구석에 처박혀 있든지 새끼야, 씨발놈아 개새끼야, 이새끼가 디질라고, 완전 또라이 새끼도 아니고,,,,”라고 욕설을 하여 공연히 피해자를 모욕하였다.
