Reasons
Punishment of the crime
[2015 Highest 4215 (Defendant A) around December 11, 2014, the Defendant presented to the victim G a check of the current unit of which the issuer H Co., Ltd., the par value is KRW 57,820,000, and which is endorsed by E and I Co., Ltd., and the Defendant presented a false statement to the effect that “A and E Co., Ltd., and I Co., Ltd., are a check of endorsement. It would pay this check, and thus, the amount remaining after payment of part of the existing debt would vary at a discount.”
However, in fact, the endorsement of the above number of units is signed and sealed by the defendant arbitrarily by forging and sealing the name plates E and I, and even if the claim against H Co., Ltd is merely 15,000,000 won and the victim received money from the victim as the price for the discount of the above number of units, there was no intention or ability to make it possible for the issuer or endorser to settle it normally on the date of payment of the above number of units.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 25,882,00 from the victim as a discount fee for the above number of units on the same day.
[2015 Highest 4956 (Defendant A)]
1. Around September 15, 2014, the Defendant forged an endorsement in the name of N, an entry of the title “EN” created by the Defendant on the back of one copy of the check number number of KRW 40,00,000 issued by L for the purpose of exercising the seal to identify the name located in the seat of the K Office located in the Namyang-si, Namyang-si, J., for the purpose of uttering. Around September 15, 2014, the Defendant forged an endorsement in the name of N, an entry of the rights and obligations of the check number of KRW 40,00,000 issued by L for the purpose of uttering.
2. Around September 15, 2014, the Defendant issued a copy of the number of units per forged, as provided in the above paragraph (1), to P, who was aware of the forgery, at Q office operated by P in the South-do P in P, Nam-si, Namyang-si.
3. The Defendant is the victim P on September 15, 2014.
