A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
1. No person who violates the Act on the Registration of Real Estate under Actual Titleholder’s Name shall register any real right to real estate under the name of the title trustee according to the title trust agreement;
Nevertheless, around February 2014, the Defendant entered into a title trust agreement to register the Defendant’s B apartment C in the name of the Defendant’s punishment D with respect to Yeonsu-gu Incheon Metropolitan City B apartment C, which the Defendant purchases in the vicinity of Yeonsu-gu Incheon Metropolitan City, and registered the ownership of the above apartment in the name of the above D around March 6, 2014 in accordance with the above agreement.
2. Forgery of private documents;
A. On August 20, 2016, the Defendant, using the form of apartment charter contract stored in the computer in Yeonsu-gu Incheon Metropolitan City, Yeonsu-gu, Incheon Metropolitan City, B apartment house C, the deposit column, the deposit money column, the remainder column, the payment column, the “A0 million won,” the “A0 million won,” the “D” in the lessor column, the “D” in the lessee column, and the “A” in the lessee column, and then marked D’s seal attached thereto.
Accordingly, for the purpose of exercising, the defendant forged one apartment lease contract in the name of D, which is a private document on rights and obligations.
B. On August 26, 2016, the Defendant forged a written consent of the transfer of a claim and the contract of the transfer of a security deposit, using the transfer of claim form, which was issued by a person in charge of G apartment C in Yeonsu-gu Incheon, Yeonsu-gu, Incheon, stating D and Yeonsu-gu B apartment C in the debtor column as “D and B apartment C,” and affixed D’s seal attached to D’s name and back to D’s name, using the written consent form for the transfer of a security deposit, and entered D’s “D,” “450,000,000” in the leased deposit form as “D”, “450,000,000” in the leased deposit form as “D”, and affixed D’s seal later.
