A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Any person who intends to operate a unregistered credit business shall register with the Mayor/Do Governor having jurisdiction over the relevant place of business in each business;

Nevertheless, on March 8, 2013, the Defendant, without registering a credit business at Changwon-si, provided loans of KRW 2 million to B, and received KRW 120,000 in cash under the name of 2-month interest rate of KRW 3% per month, and received interest (38.3% per annum) at the interest rate of KRW 3% per month for the above 2 million as three-month interest rate, from that time until February 27, 2017, the Defendant engaged in credit business by providing loans of KRW 252,00,000 in total to B, C, D, E, and F, etc. 33 times in total.

2. Where an unregistered credit service provider, who violates the interest rate, lends a loan, the interest rate on the loan shall not exceed 30% per annum from June 30, 2007 to July 14, 2014, and 25% per annum from July 15, 2014 to February 7, 2018.

Nevertheless, the Defendant, without registering a credit business with the competent authority, loaned KRW 10,000,00 to C around November 26, 2013 as shown in the annexed Table No. 8 of Crimes List of Attached Table Nos. 1, 2013, and received KRW 600,000 as advance interest, and the repayment period was 12 months in cash, with the above KRW 10,000 as interest rate of KRW 3% per month, and received interest exceeding the above restriction rate (38.3% per annum), and received interest from February 27, 2017 by the method of receiving interest (38.3% per annum).
