1. The Defendant’s KRW 80,89,206 with respect to the Plaintiff and KRW 5% per annum from January 1, 2012 to November 18, 2013.
Reasons
1. Basic facts
A. The Plaintiff is a company that analyzes ingredients by being commissioned to conduct a quality test of materials ingredients in the field of civil engineering, and the Defendant served as the director in charge of the test from May 16, 2008 to March 31, 2012 at the Plaintiff’s athletic branch in Pyeongtaek-si.
B. From September 12, 2008 to January 5, 2010, totaling KRW 49,397,030, totaling KRW 47,982,000 from January 31, 201 to December 31, 2010, and totaling KRW 42,87,700 from January 25, 201 to December 31, 201, were remitted to the Defendant’s account, respectively.
C. According to the wage ledger kept by the Plaintiff, the Defendant’s salary in 2008 and 2009 is indicated as KRW 2,00,000 per month (before deducting various insurance premiums and taxes), the total salary from January 201 to December 2010 is indicated as KRW 27,972,830, and the total salary from January 201 to December 201 is indicated as KRW 27,060,660.
Meanwhile, from the Plaintiff’s account on January 12, 2010, KRW 3,000,000, KRW 12,000,000 on December 31, 2010, and KRW 23,000,000 on June 9, 2011, and KRW 23,000,000 on August 3, 201, were remitted to the Defendant’s account respectively; KRW 30,000,00 on January 23, 200, KRW 30,000 on June 30, 200, KRW 200 on June 24, 200, KRW 300 on July 24, 200, KRW C0 on each of its own account; and KRW 30,00 on June 30, 200 on each of its own account; and KRW 30,00 on June 30, 200.
E. The Defendant held claims against the Plaintiff at the time of November 30, 2008. However, the Defendant’s amount of claims settled on July 31, 2009 is KRW 28,33,333, and the Defendant’s amount of claims deposited in C account on January 23, 2009, KRW 30,000,000, and the amount of the annual salary in 2010, and KRW 4,000,00,000, which was deposited in the Defendant account on June 9, 201, and KRW 4,00,000,000, which was deposited in the Defendant account on August 3, 2011, and signed the balance on the confirmation document confirming that the Defendant’s claim was fully paid from the Defendant’s credit amount.
