1. The Defendant shall pay to the Plaintiff KRW 41,818,680 as well as 20% per annum from April 16, 2012 to the day of full payment.
Reasons
In full view of the purport of the entire pleadings, evidence Nos. 2 and 3-4, and evidence Nos. 4 through 17 (including each number of evidence Nos. 10 through 14), the Plaintiff worked as an employee of the Defendant who ordinarily employs not more than four workers from April 1, 2008 to March 31, 2012; the Defendant’s salary between the Plaintiff and the Defendant is KRW 1.5 million from May 2008 to May 2010; KRW 1.65 million from June 2010 to December 2010; and KRW 2 million from January 201 to December 5, 201; and KRW 3 million from the Defendant’s payment to the Plaintiff’s payment to the Plaintiff’s account as well as KRW 5 million from May 2008 to the Plaintiff’s payment to the Plaintiff’s payment to the Plaintiff’s account (hereinafter the same shall apply).
As to this, the defendant argued that ① the plaintiff worked as the defendant's employee from March 2, 2009, ② the plaintiff's salary between the plaintiff and the defendant was KRW 900,000 per month from March 2, 2009 to January 201, from February 2011, KRW 902,880 per month from February 201 to January 2012, and KRW 957,20 per month from February 2012 to the retirement date, and thus, the plaintiff stated that the plaintiff's work experience certificate prepared by the defendant and the beneficiary recognition application were the defendant's employee from April 1, 208 to the defendant's employee, ② the first salary paid by the defendant to the plaintiff from May 5, 2008, KRW 150,000 per month from the defendant's first wage was increased, KRW 500,000 per month from June 25, 2010 to the plaintiff's wage was paid to the plaintiff.
