Punishment of the crime

1. The criminal defendant is a person who engages in the artificial insemination business under the trade name of “B”.

On August 8, 2016, the Defendant, by telephone, paid 6.2 million won to the victim C with the “D Apartment 1, 507 remodeling construction work,” as the Changho construction work is completed.

The phrase “ makes a false statement.”

However, the Defendant received all the construction cost of KRW 25 million in the interior building of a commercial building separately in progress, and was unable to pay the said money as the construction cost to the subcontractor by using the Defendant’s debt repayment for the Defendant’s debt. Since most of the construction cost of the above apartment building was scheduled to be paid for other construction cost, the Defendant did not have the intent and ability to pay the construction cost at the time.

Nevertheless, the Defendant deceiving the victim as above and caused the victim to do so from August 5, 2016 to July 7, 2016, thereby acquiring property benefits equivalent to the above amount due to the failure to pay the construction cost.

2. On April 20, 2016, the Defendant is a person subject to registration of personal information who was sentenced to six months of imprisonment with labor or two years of suspended execution due to an indecent act committed by Busan District Court on April 20, 2016

Even though the Defendant moved to the same apartment building 211 Dong Dong-dong 1901 at around July 13, 2017, the Defendant failed to submit such alteration details to the head of the competent police office within 20 days, even though he/she moved to the same apartment building 209 Dong-gun 1302.
