1. The Defendant’s KRW 100,000,000 for the Plaintiff and 6% per annum from December 26, 2017 to January 17, 2018.

Basic Facts

According to the purport of the evidence No. 1 and the whole pleadings, the Plaintiff’s endorsement and transfer of the check amount of KRW 200 million per face value issued by the Defendant on December 22, 2017, and the Plaintiff presented the Industrial Bank of Korea’s store store on December 26, 2017 with the payment proposal of the check amount. However, the Plaintiff’s failure to receive the check amount after receiving the report of accident on December 22, 2017 can be recognized.

Judgment

According to the above facts, the defendant is obligated to pay to the plaintiff 10 million won and the amount of money calculated by each rate of 6% per annum under the Commercial Act from December 26, 2017 to January 17, 2018, the delivery date of a copy of the complaint of this case, which is the day following the date of the above payment proposal, and 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of full payment.

The plaintiff's claim for conclusion is justified and it is so decided as per Disposition.
