Punishment of the crime

On May 14, 2014, the Defendant was sentenced to one year of imprisonment for fraud in the Dong branch of the Busan District Court, and the execution of the sentence was terminated on January 20, 2015.

On November 25, 2015, 2015, the Defendant posted a letter “to sell a performance ticket inside the C poppy” on the Korean bulletin board, and said letter reads “to send a contact ticket if you send KRW 80,000 to the victim D who reported and contacted the letter.”

However, the defendant thought that he will receive money from the victims of the fact and did not possess the contact diskettes, so even if he received money from the victims, he did not have the intention or ability to send such money to the victims.

The Defendant received 80,000 won from the victim's new bank account (Account Number F) in the name of E on the same day from the victim, and received 2,394,500 won in total as the price for the goods from the victims over 18 times in the following manner from January 31, 2016 from that time to January 31, 2016.

On September 12, 2015, the Defendant posted a letter "to sell merchandise coupons in a department store" on the Korean bulletin board at the Blue House on September 12, 2015, and the victim G who reported and contacted the letter "to send KRW 500,000 to 50,000,000."

However, the fact that the defendant received money from the injured party and thought to use it for the cost of living, and there was no intention or ability to send merchandise coupons even if he received money from the injured party.

Nevertheless, the defendant deceiving the victim as above and transferred KRW 500,000 to the corporate bank account (H) in the name of the defendant as the price for the same merchandise coupon on the same day from the victim, from November 13, 2015 to November 28, 2015.
