A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On June 8, 2017, the Defendant posted an article to the Internet portal F “G” page to the effect that “If you send the price first, you will send the H contact book to her choice.” However, since the Defendant did not possess the above Twit book, the Defendant did not have any intent or ability to send the above Twit book even if they receive the payment from the victim I.
As above, the defendant deceivings the victim I and transferred KRW 300,000 from the victim I to the J bank account (K) in the name of the defendant on June 8, 2017.
In addition, the Defendant, from June 2, 2017 to June 12, 2017, received 3,750,000 won in total under the name of the victims as shown in the list of crimes in attached Form 10 times from around 10 to around 12, 2017.
Accordingly, the defendant was informed of the victims to receive property.

1. On June 11, 2017, the Defendant posted a false statement on the Internet F “G” camera to the effect that “The Defendant would transfer the H contact pockets to the victim L who reported and contacted with the Defendant.” The Defendant made a false statement to the effect that “The Defendant would transfer the H contact pockets if he sent the price first.”
However, even if the defendant did not possess the above contact pockets and received the payment from the injured party, he did not have any intention or ability to transfer the above contact pockets.
The defendant was transferred 300,000 won to the J bank account (K) in the name of the defendant as the price for the same day from the damaged person.
2. On July 4, 2017, the Defendant posted a letter stating “Aphone 6S is transferred” on the Internet FG car page at a closed place, and reported this fact to the victim M who had contacted with the Defendant, who sent 200,000 won of the price to the first place, and received the goods.
