A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

From November 2012, the Defendant was in death with the victim C.

1. Fraud;

A. The Defendant, at the end of February 2016, obtained a loan from the victim due to the Plaintiff’s death on June 20, 2015, due to his/her funeral expenses, the credit rating decline, if it is impossible to repay the loan due to delayed payment.

The purport of the joint and several sureties was that loans that were borrowed for funeral expenses are repaid, and the loans that were jointly and severally guaranteed are about to be repaid.

However, in fact, the defendant's attachment did not die, and there was no fact that the defendant was granted a loan due to the funeral expenses of the defendant, and there was no intention or ability to settle the loan due to the lack of any particular income or property to repay the loan to the defendant.

Around February 2016, the Defendant: (a) deceiving the victim; (b) had the victim take advantage of the victim’s identity; (c) around the end of February 2016, 400,000 won from the lending company of the Dong-U.S.; (d) 4 million won from the company located in the T-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-

B. On April 2016, the Defendant stated that, using handphones in the electronic Ireland located in the Busan Northern-dong, the Defendant: “In order to obtain loans in the name of four and thereafter thereafter, the Defendant was aware of the change of the name holder in the future, and received 60 million won loans from three places of the lending company.”

However, in fact, the Defendant was thought to use the loans that have already been received from the loan companies as a total of KRW 30,000,000, and the Defendant was able to use the loans from the damaged parties due to excessive consumption.
