1. The Defendant (Counterclaim Plaintiff) paid KRW 18,251,651 to the Plaintiff (Counterclaim Defendant) and its related amount from April 23, 2011 to September 12, 2013.

1. Facts of recognition;

A. On July 15, 2008, the Defendant entered into a contract with the Hyundai Master Co., Ltd. to manufacture vehicles, base facilities, equipment, etc. (hereinafter “the instant goods”) to be supplied by the said Hyundai Master Company according to an agreement with the Almath Kazam Kastan, the subway Corporation, and supply them to the Almath Meart.

B. Around June 30, 2010, the Defendant made the instant goods, and around June 30, 2010, entered into a cargo transport contract with the Plaintiff, which is a transportation company, on condition that the instant goods are transported to the designated place of Almati, which is the destination of destination (hereinafter “instant contract”). (See subparagraph 1 of A and Article 1 of the Cargo Transport Contract), the Defendant agreed to divide the instant goods into 66 items from among the instant goods into two-lanes, and two-lanes, and deliver them to Almati, Inc.

C. Around June 2010, the instant goods arrive at the logistics warehouse of the treatment Lochis located in the Southern Port of Incheon, and the Plaintiff entered into a service contract with the Maritime Export Service Co., Ltd. (hereinafter “Packing company”) that is the packing company, and had the packing company carry out the packing work of the instant goods.

이 사건 물품 중 1차 운송분 66개 물품이 2010. 7. 2.경 14개의 컨테이너에 적재되었고, 2010. 7. 6.경 인청항에서 ‘Zi Yu Lan' 호에 선적되어 2010. 7. 7.경 중국의 롄윈강(Lianyungang) 항구까지 운송되어 그곳에서 하역된 다음, 철도를 이용하여 알마티까지 운송되어 2010. 10. 5. 지정된 알마티 소재 최종 목적지에서 인도되었다.

E. On October 18, 2010, some of the instant goods were destroyed due to the removal from containers on the first carriage of the instant goods.

F. With respect to the second carriage of the instant goods, from November 201, the transport commenced from November 201, but rather than the expected arrival date.
