Reasons
Punishment of the crime
On June 17, 2015, Defendant A was sentenced to one year of imprisonment for a crime, etc. at the Suwon District Court on June 17, 2015, and on January 8, 2016, on September 1, 2016, Defendant A completed the execution of each of the above punishment in the Gansung Vocational Training Correctional Institution on September 1, 2016. On July 18, 2018, Defendant A was sentenced to one year and four months of imprisonment for a special larceny, etc. in a member of the Suwon District Court’s Eunpyeong District Court’s Housing Site, which became final and conclusive on November 1, 2018.
【Criminal Facts】
1. Defendant A and Defendants B posted an article stating that they sell used goods on the Internet C website, and submitted the article to the victims who reported and contacted the article to the new bank account (D) in the name of Defendant A, and conspired to divide the amount into two parts.
On November 20, 2017, the Defendants inserted an article on the Internet C site that “I am galthal lusium S7” on the falthal of the insular site (hereinafter referred to as “I am falthal jusium”) and falsely inserted that “I am 170,000 won by deposit of KRW 170,000 to deliver the cell phone at home.”
However, the Defendants did not have the above mobile phone so that they did not have the intention or ability to send the goods.
In collusion, the Defendants received 170,000 won from five victims through the same method from around the time to November 21, 2017, by deceiving the victims and receiving 170,000 won from the said new bank account under the name of Defendant A.
2. On February 21, 2018, Defendant A and Co-Defendant F posted an Internet G to sell game money with a view to preparing living expenses in and around the Seo-gu Incheon, Seo-gu, Incheon, and around the Central Market Station, and then posted an Internet G to sell game money, and the victims who reported and contacted with the said article have been transferred the money.
