1. The Defendants jointly share KRW 5,500,000 for each of the Plaintiffs and their respective years from September 7, 2015 to September 11, 2018.
Reasons
1. Facts of recognition;
A. Defendant SS Co., Ltd (hereinafter “Defendant Co., Ltd.”) is a company that runs the repair business of household appliances using 87 full-time workers at the office of the head office on the Seoul Southern-gu V and the second floor, Nam-gu, Incheon, and U is a person who held office as the representative director of the Defendant Co., Ltd. until January 24, 2017.
B. The Plaintiffs, who are employed by the Defendant Company and worked as the repair engineer for the household appliances in services, are the members of the W Trade Union X-Subdivision Y (hereinafter “Plaintiff Union”).
C. 20 members of the Plaintiff Union, including the Plaintiffs, submitted a written complaint to the Central and Medium Local Employment Agency on December 17, 2014 with respect to the fact that the Defendants were not to assign repair duties to the members from December 2014 to December 17, 2014.
With respect to the facts of the accusation stated in the above paragraph (c), the Defendant U was sentenced to a fine of KRW 1,000,000 for the following criminal facts in the case of violation of the Incheon District Court Decision 2016 High Court Decision 1753, Sept. 9, 2016, and the above judgment became final and conclusive.
An employer shall not dismiss or put any worker at a disadvantage on the ground that the worker has joined or attempted to join a trade union, or has attempted to organize a trade union, or has performed any other lawful act for the operation of a trade union.
Nevertheless, during the period from December 1, 2014 to September 6, 2015, Defendant U allocated duties to non-members of the household electric appliances repair work for the non-members of the workplace until 17:10 per day, while Defendant U allocated duties to non-members of the household electric appliances repair work for the non-members of the workplace, Defendant U allocated duties for up to 16:30 per day to the non-members of the household electric appliances repair work for the number of 16:50,000 won per worker of the union.
E. Workers belonging to the defendant company including the plaintiffs are assigned by the defendant company to repair works (repair hours are assigned to 50 minutes per case).
