1. The defendant is among the land listed in the attached list to the plaintiff.

1. Basic facts

A. The Plaintiff completed the registration of ownership transfer on May 31, 198 with respect to the land indicated in the attached list (hereinafter “instant land”) and the housing on the ground, and the Defendant completed the registration of ownership transfer on July 12, 1985 with respect to the land and the housing on the ground (hereinafter “instant land”) located in Gunpo-si adjacent to the instant land.

나. 피고는 이 사건 토지 중 별지 도면 표시 7, 2, 14, 13, 12, 11, 8, 7의 각 점을 차례로 연결한 선내 ㉢ 부분 5.5㎡(이하 ‘이 사건 ㉢ 부분’이라 한다) 지상에 각종 재활용품을 적치해 두었고, 이 사건 토지 중 별지 도면 표시 6, 7, 8, 9, 6의 각 점을 차례로 연결한 선내 ㉠ 부분(이하 ‘이 사건 ㉠ 부분’이라 한다)에 샌드위치 패널 지붕 2.6㎡를, 이 사건 토지 중 별지 도면 표시 13, 14, 15, 16, 13의 각 점을 차례로 연결한 선내 ㉣ 부분(이하 ‘이 사건 ㉣ 부분’이라 한다)에 철문 및 기둥 0.2㎡를 각 설치하였다.

2. 원고 주장의 요지 이 사건 ㉠, ㉢, ㉣ 부분은 원고 소유의 토지인데, 피고가 아무런 권원 없이 이 사건 ㉠ 부분에 샌드위치 패널 지붕 2.6㎡를, 이 사건 ㉣ 부분에 철문 및 기둥 0.2㎡를 각 설치하고, 이 사건 ㉢ 부분에 재활용품 등을 방치하고 있는바, 피고는 원고의 소유권에 기한 방해배제청구권의 행사에 응하여 위 각 시설물을 철거하고 적치물을 수거하며, 이 사건 ㉠, ㉢, ㉣ 부분 합계 8.3㎡를 인도할 의무가 있다.
