Reasons
Punishment of the crime
I. Defendant A of the Criminal Power is a person who had been sentenced to the suspension of the execution of ten months in the military court of the Army on December 29, 1989, from the Daegu District Court and its branch on August 25, 199 to the punishment of attempted larceny, two years and four months in imprisonment with prison labor on October 4, 2007 to the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Chuncheon District Court on October 4, 2007, and ten months in imprisonment with prison labor on July 22, 2010 to the punishment of attempted larceny.
II. Criminal facts
1. The Defendants’ co-principal
A. At around 01:50 on September 1, 2014, the Defendants: (a) used the DNS car driven by Defendant B to use the DNS car in front of 102 Efined-gun Efined-guned-gun; (b) Defendant B reported the network; and (c) Defendant A destroyed the windows of G Efin-gun’s car parked in the front door of the Victim F, which was parked therein, by cutting the day-type dricker into the front door of the CF car; and (d) carried KRW 200,000,000,000 won of the market price of which the goods were stored in the goods.
B. On September 17, 2014, from around 03:00 to 03:30, the Defendants: (a) used the DNS car driven by Defendant B to the 45-dong underground parking lot located in the south-gu Newline 45, Ulsan-gu, Ulsan-si; (b) Defendant B reported the network; and (c) Defendant A attempted to destroy the Victim H I NAS car parked in that place by cutting the dricker’s window onto the stud window of the INS car; and (d) attempted to steal the property by cutting the drick window, but failed to discover the property.
C. On September 17, 2014, from around 03:00 to 03:30, the Defendants came to use a DNA car operated by Defendant B to a lot 213 underground parking lot located in the south-gu Newline 45, Ulsan-gu, Ulsan-si, and Defendant B reported the network, and Defendant A was parked at that place, and Defendant A was the owner of the victim’s JJ.
