A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

2. 2013. 10. 17. 범행 피고인은 2013. 10. 17. 16:08경 자동차운전면허 없이 전남 보성군 득량면 송곡리에 있는 도로에서부터 같은 리 군두사거리 앞 도로까지 약 150m 구간에서 E 렉스턴 승용차를 운전하고, 군두사거리에서 전방주시 의무를 게을리한 과실로 도로변에 있던 교통신호기 제어장치를 충격하는 사고를 내어 2013. 17:05경부터 17:45경까지 전남 보성군 F에 있는 보성경찰서 G파출소에서 피고인에게서 술냄새가 나고 얼굴에 홍조를 띠는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 경사 H 등으로부터 3회에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 호흡측정에 의한 음주측정을 요구받았음에도 호흡측정기에 입김을 불어 넣는 시늉만 하는 방법으로 이를 회피하여 경찰관의 측정 요구에 응하지 않았다.
