The plaintiff's claim against the defendants is dismissed in entirety.

1. Basic facts

A. The Plaintiff is a university student who entered the nursing department (hereinafter “instant nursing department”) of the E University (hereinafter “instant University”) operated by Defendant School Foundation B (hereinafter “Defendant School Foundation”) around March 2016.

As a professor of the instant nursing department, Defendant D was in charge of taking care of the subjects of nursing care (2) (hereinafter “instant subjects”) in the second semester of 2018, and was the Plaintiff’s instruction professor.

B. Of the school regulations of the university of this case, the contents of this case are as follows.

Article 47 (Examination) (1) In order to evaluate the grades of each subject, an examination shall be conducted at the end of a semester.

Provided, That an interim examination may be conducted during a semester, and where necessary, an examination necessary for graduation may be conducted according to the characteristics of the department.

Article 49 (Performance) (2) It is recognized that credits have been obtained at the time when the results of subjects are not less than D0.

Article 52 (Completion of Courses by Each department determined by the President of UNIST, and a person meeting each of the following subparagraphs shall be granted a degree, and a certificate of degree may indicate a major in the course of study:

1. A person who has earned 80 credits or more (120 credits or more for a three-year course, 140 credits or more for a four-year course);

2. A person who has completed all the essential subjects;

C. The nursing department of this case is above B.

Pursuant to Article 47(1) of the school regulations of this subsection, the requirements for academic students to pass the graduation examination as necessary to graduate from the university of this case were imposed.
