1. The Plaintiff:
A. Defendant B Co., Ltd.: (a) KRW 1,460,759,728 and KRW 101,00,000 among them, respectively; (b) January 24, 2014.
Reasons
1. Basic facts
A. The plaintiff is the party to the dispute 1) The 730 households, Dong-dong, Daegu-gu, Daegu-gu, A apartment house (hereinafter "the apartment of this case").
In order to manage the apartment complex, Defendant B Co., Ltd. (hereinafter “Defendant B”) is a project undertaker who constructed and sold the apartment complex of this case, and Defendant C Co., Ltd (hereinafter “Defendant C”) is a new construction work of the apartment complex of this case by being awarded a contract with Defendant B for the new construction work of the apartment of this case.
3) Defendant Construction Mutual Aid Association (hereinafter “Defendant Mutual Aid Association”)
(B) The Defendant C Co., Ltd. guaranteed the obligation to repair the defects of the instant apartment. B) Around February 19, 2005, Defendant B entered into a contract with Defendant C on March 26, 2005 after obtaining the approval of the project plan for the instant apartment construction from the competent authority on February 19, 2005, and entered into the said contract with Defendant C on March 26, 2005 (hereinafter referred to as the “instant contract”).
(C) On August 2, 2005, Defendant C commenced the construction of the instant apartment on or around August 2, 2005. (c) On June 17, 2008, Defendant C and the secured creditor are the head of the Daegu Metropolitan City Seo-gu, which entered into each contract for the repair of defects with respect to the new construction of the instant apartment as indicated below, and issued each contract for the repair of defects as to the new construction of the instant apartment.
(1) Each guarantee agreement entered into as mentioned above shall be construed as "each guarantee agreement of this case".
