The prosecutor's appeal is dismissed.
Reasons
1. The lower court’s sentence against the Defendant in light of the gist of the grounds for appeal is deemed unreasonable.
2. The lower court determined the Defendant’s punishment on the grounds of sentencing as stated in its reasoning. In full view of the circumstances stated by the lower court and all other sentencing conditions in the proceedings of the instant case, it cannot be deemed that the lower court’s punishment is too uneasible and unreasonable.
Therefore, prosecutor's assertion is without merit.
3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
