The prosecutor's appeal is dismissed.

1. The lower court’s sentence against the Defendant in light of the gist of the grounds for appeal is deemed unreasonable.

2. The lower court determined the Defendant’s punishment on the grounds of sentencing as stated in its reasoning. In light of the records, the lower court’s punishment is too unjustifiable even when comprehensively taking into account the circumstances presented by the lower court and all the sentencing conditions indicated in the proceedings of pleadings in this case.

Therefore, prosecutor's assertion is without merit.

3. In conclusion, the prosecutor's appeal of this case is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
