1. The Defendant shall pay to the Plaintiff KRW 31,00,000 per annum and 15% per annum from September 11, 2018 to the date of full payment.

Reasons

Comprehensively taking account of the respective descriptions and the overall purport of arguments in Gap evidence Nos. 1 and 5 (including each number), it is recognized that the plaintiff entered into a lease agreement with the defendant on February 24, 2014, under which the plaintiff agreed to lease Nos. 5 (hereinafter "the instant house") with the term of lease deposit of KRW 60 million and KRW 4 million with the term of lease of KRW 2 years, extended the term of lease on February 2016, and paid the lease deposit of KRW 15 million with the extension of the term of lease of two years; the plaintiff notified the defendant on February 13, 2018 that he/she did not intend to renew the contract; the fact that he/she delivered the instant house to the defendant on April 18, 2018; the fact that the defendant paid the plaintiff the lease deposit of KRW 75 million with the term of lease deposit of KRW 4 million with the plaintiff.

In full view of the above facts, the Defendant is obligated to pay the Plaintiff the remainder of the lease deposit amount of KRW 31 million and the damages for delay calculated at the rate of 15% per annum from September 11, 2018 to the day when the copy of the complaint of this case is served to the day when the payment is made.

Therefore, the plaintiff's claim is reasonable, and it is so decided as per Disposition to accept it.
