Defendant shall be punished by a fine of KRW 3,500,000.
If the defendant does not pay the above fine, the amount of KRW 100,000 shall be paid.
Reasons
Punishment of the crime
The Defendant managed the frequency of “D” in the trade name of “Seoul building 102” in Gyeyang-gu, Incheon, and transferred the said frequency to the Victim E on March 29, 2013, and thereafter worked as the main kitchen of the said frequency from that day to April 18, 2013.
1. On March 29, 2013, the Defendant transferred a collection of frequencies to the victim, but had the name of a credit card merchant under the name of the Defendant, and had the credit card merchant money remitted to the agricultural bank account under the name of the Defendant, with the intent to arbitrarily consume part of the said money.
Accordingly, the Defendant voluntarily consumed KRW 3,730,590, out of the above amounts from April 5, 2013 to May 15, 2013, when he/she was transferred to a new credit card company for the victim under the name of the above frequency chain store price, and was kept for the victim. From that point, the Defendant received a total of KRW 5,730,590 in the same way as indicated in the attached crime list from April 17, 2013 to April 17, 2013, while he/she received a transfer of KRW 5,730,590 in the same way as indicated in the attached crime list and kept for the victim.
Accordingly, the defendant embezzled the victim's property.
2. Larceny;
A. (1) On March 30, 2013, the Defendant stolen KRW 50,000,000, which was the victim’s possession of cash stored at the same time, from March 30, 2013.
(2) On April 6, 2013, the Defendant, at around 20:40, stolen KRW 30,000, the cash possessed by the victim, which was kept in cash at the above frequency.
(3) On April 14, 2013, the Defendant, at around 19:50, stolen KRW 30,000, cash possessed by the victim who had been in cash custody at the above frequency.
B. On April 22, 2013, at around 16:00, the Defendant thief, including a kitchen tool, entered the above frequency room, and cited one in good faith, two knives for kitchen use, one electric knives, and one cell phone charging device.
