1. The defendant shall pay 26,90,000 won to the plaintiff and 20% per annum from June 18, 2014 to the day of complete payment.
Reasons
1. The following facts may be found either in dispute between the parties or in the entry in Gap evidence 1 and Eul evidence 4, taking into account the whole purport of the pleadings:
On June 2013, the plaintiff and the defendant developed into the relationship of internal ties by introducing a branch of a branch of the second time.
B. Thereafter, the Plaintiff transferred to the Defendant KRW 3,500,000 in total, KRW 33,500,000 (hereinafter “instant money”) on July 20, 2013, KRW 27,000,000, KRW 32,000 on August 22, 2013, KRW 200,000 on October 17, 2013, and KRW 50,000 on January 24, 2014 (hereinafter “instant money”).
C. Meanwhile, the Defendant paid KRW 6,50,000 to the Plaintiff, and KRW 5,00,000 to the Plaintiff on October 26, 2013, and KRW 1,500,000 to the police officer on November 2013.
2. The parties' assertion and judgment
A. The Plaintiff’s assertion 1) lent the instant money to the Defendant upon the Defendant’s demand for loans, such as operating expenses and business funds. However, the Defendant paid to the Plaintiff the sum of KRW 6,500,000 for the Defendant’s KRW 5,000 on October 26, 2013, and KRW 1,500 on November 201, 2013, and KRW 100,000 out of the instant money was disbursed to the Plaintiff as the Plaintiff’s expenses for surgery. Accordingly, the Plaintiff claimed that the remainder of KRW 27,50,000 (= KRW 33,500,000 - KRW 6,500,000 - KRW 6,500,000 on behalf of the Plaintiff, deducted the remainder of KRW 26,90,000 on behalf of the Plaintiff, and damages for delay on the remainder of KRW 3,500,000 on the instant money.
Even if the entire money of this case is a loan, it constitutes illegal consideration as conditioned to maintain internal relations with the Defendant, and as well as part of the money of this case (500,000 won out of KRW 2,00,000) was exempted at the time of payment of KRW 1,50,000 among November 201, 2013, and the remainder of the money is worth KRW 15,000,000 to KRW 20,000,000.
