A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특수협박 피고인은 2019. 11. 24. 19:45경 서울 강서구 C아파트 동 호에 있는 피해자의 주거지에 찾아간 후, 피해자의 요구에 의해 헤어진 것에 대해 불만을 가지고 피해자와 대화를 나누던 중 피해자가 다른 남자와 교제를 하였다는 이유로 화가 나 싱크대에 있는 위험한 물건인 식칼(칼날길이 약 20cm)과 과도를 꺼내와 한손으로 식칼과 과도를 쥔 상태에서 식칼 끝은 피해자의 배 부위에, 과도 끝은 자신의 배 부위에 갖다 대면서 “나는 너와 헤어지는 것이 억울하다, 집에 불 싹 다 지르고 나도 죽어버리겠다, 너를 죽여버리고 죽겠다”라고 말하는 등 위험한 물건을 휴대하여 피해자를 협박하였다.
