[Defendant A] The defendant shall be punished by imprisonment with prison labor for one year

However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is an intermediate distributor that supplies inorganic Masan (HCL, approximately 35%) a hazardous chemical substance to Seocheon Kim Gmcheon-si Kim. Defendant B is a representative director of P Co., Ltd., a chemical medicine treatment firm located in Ulsan-siO in Ulsan-si, who supplies inorganic Masan produced in the above company to Defendant A, and Defendant C, Defendant D, Defendant E, and Defendant F is a person who operates Kim Gmcheon-gun.

1. Defendant A

(a) No person who violates the Control of Chemicals Act shall operate or handle harmful chemicals without obtaining permission to conduct a business of harmful chemicals or after obtaining permission by fraudulent means;

Nevertheless, without permission from the competent authority on February 20, 2017, the Defendant purchased inorganic salt acid (HCL, approximately 35%) 22,203 litress, a harmful chemical, from P, the representative director of P, U.S. P, U.S. P, U.S., the head of Ulsan-gun, and stored it in a storage tank (30 tons) located in Q, U.S. for the purpose of sale to the Ilcheon-gun, Seocheon-gun, Seocheon-gun, Chungcheongnam-gun, the Defendant stored in a storage tank (30 tons) located in Q, U.S. for the purpose of sale, and kept in total 50 times from December 2, 2015 to February 20, 2017.

Accordingly, the defendant treated harmful chemicals without permission of the competent authorities.

(b) No one shall keep or use harmful chemicals for the purpose of cultivating fishery resources or removing foreign substances attached to fishing implements or fishing nets;

Nevertheless, the defendant, while running the business of selling inorganic acid from Chungcheongnam-gun Q for the above period, he knew that Kim Farming business entities use inorganic acid for Kim Farming business, and even though he well aware that he/she used inorganic acid for Kim Farming business, he/she totaling 6,000 litres per (20 litress) per 6,000-liters per total twice during the period from November 2016 to December 2016 to Kim Farming business.
