A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Any person who intends to conduct a hazardous chemical business in violation of the Control of Chemicals Act shall obtain permission from the Minister of Environment for each type of business equipped with handling facilities and human resources for each hazardous chemical in conformity with standards prescribed by Ordinance

Nevertheless, on December 13, 2012, the Defendant sold salt acid (35.3%) 7,500 L, a harmful chemical substance, to D, an Kim farmer, in the Yancheon-gun, Chungcheongnam-gun, Chungcheongnam-gun, without obtaining permission from the Minister of Environment, in the amount of KRW 3,00,00 from around that time to December 30, 2015, and sold 246,654,50 L, a total amount of KRW 106,00 in total, as indicated in the attached crime list from around December 13, 2015, to 3,08,850 L, a harmful chemical seller, in order to sell it to Kim In-gun, Seocheon-gun, and E for the purpose of removing this substance from the fishing gear above at around 14:00 on December 30, 2015.

2. No person who aids and abets the management of fishery resources shall keep or use harmful chemicals for the purpose of cultivating fishery resources or removing foreign substances attached to fishing nets;

On December 13, 2012, the Defendant sold 7,500 L, a harmful chemical substance, to D, an Kim Farming business entity, as above, in the Yacheon-gun, Chungcheongnamcheon-gun around December 13, 2012. Around that time, the Defendant aided and abetted the Defendant to commit a violation of fishery resources management of D, etc. by facilitating the storage and use of salt, a harmful chemical substance, for the purpose of removing foreign substance attached to fishing gear and fishing net, from the Kim Farming-gun to December 30, 2015, including the list of crimes in the attached Table, by selling 608,850 L, which is a harmful chemical substance, to remove the fishery gear and fish net, and by facilitating the storage and use of salt, a harmful chemical substance, for the purpose of removing the foreign substance attached to the fishing gear and fishing net.
