1. Basic facts

A. On November 20, 2013, the Defendant filed a petition for a trial to confirm the scope of a patent right (2013DaDa3051) by asserting that the challenged invention does not fall under the scope of the right of the instant patent invention (hereinafter “instant Claim No. 1”) with the Intellectual Property Tribunal against the Plaintiff, a patentee, on November 20, 2013. (2) The Intellectual Property Tribunal rendered a petition for a trial to confirm the scope of a patent right (2013DaDa3051) by asserting that the challenged invention in question does not fall under the scope of the patent right of the instant patent invention. (3) On March 31, 2015, the challenged invention in question is a free-to-work technology that a person with ordinary knowledge in the technical field to which the invention pertains (hereinafter “ordinary technician”) can easily conduct. Accordingly, the instant trial decision cited by the Defendant on the ground that the challenged invention does not fall under the scope of the right without need to compare the instant Claim No. 1 invention.
