A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On January 9, 2017, the criminal defendant against the victim B made a false statement to the victim B, who is located in Jeju-si, that “If the victim B lends KRW 10 million to the beneficiary B, he/she shall repay the victim KRW 800,000 as interest per month.”
However, the defendant had no intention or ability to pay money even if he borrowed money from the victim because he did not have any property or income.
The Defendant, as such, by deceiving the victim, received KRW 9,200,000 from the E bank (Account Number:F) in the name of the Defendant on the same day, from that time, and acquired the money by deceiving KRW 5,270,000 in total seven times from April 22, 2017, as shown in attached Table 1.
2. Around March 10, 2017, the defrauded of the Victim G, the Defendant: (a) around March 10, 2017, at the I head room operated by the Victim G in the H and the second floor at the Jeju-si; (b) “Ackin and the second floor is opened to the public; and (c) money is required to be used and repaid only for every 500,000 won of interest if the Defendant borrowed 5 million won.”
However, in fact, the defendant was making a prompt return, and there was no particular property or income, so even if he borrowed money from the victim, he was thought to use part of the money for the number of days, and there was no intention or ability to repay it.
The Defendant, as such, by deceiving the victim, received KRW 4,500,000 from the E bank (Account Number:F) in the name of the Defendant on the same day, from that time, and acquired the money by deceiving KRW 13,40,000 in total on four occasions from April 26, 2017, as shown in the attached Table 2 of Crimes List 2.
3. On May 8, 2017, the Defendant against the victim J is urgently required to post a telephone to the victim J at a place where it is difficult to know the location below the date of Jeju on May 8, 2017.
A loan shall be made only five million won for the reduction of five copies per month after a month of interest.
