The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal in the judgment of the court below is unreasonable because the punishment of a fine of 80,000 won is too unhued.
2. In full view of the fact that the defendant is in a first offense, the defendant's occupation, age, and all other matters concerning the sentencing specified in the records and arguments in this case, the judgment below's punishment is deemed appropriate, and the prosecutor's above assertion is without merit.
3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
