Punishment of the crime

[2013 Highest 1273] On September 20, 2013, the Defendant made a false statement that “The Defendant would send KRW 700,000 to a door-to-door, if he received a prior payment from an account,” on the Internet site “galls k5,” and that “The Defendant sold a car log and wheelchairs posted by the Defendant,” and that “The Defendant would send it to a door-to-door.”

However, there was no intention or ability to send the goods promised even if the Defendant received the price for the goods from the victim because the Defendant did not have a wheel with a motor vehicle at the time.

The Defendant received KRW 700,000 from the victim as the price for the goods and received KRW 5,420,000 in total over 16 times from around that time to November 18, 2013, as shown in the crime list.

Accordingly, the defendant was provided property by deceiving the victims.

[2013 Highest 1291] On September 8, 2013, the Defendant made a false statement to the effect that “the Defendant will send the HE to the Defendant, if he received the advance payment,” by making a false statement on the purchase agreement at the Internet’s “China” website for trading used goods.

However, there was no intention or ability to send the goods promised even if the Defendant received the price for the goods from the victim because the Defendant did not have the hedging at the time.

The Defendant received 200,000 won as the price for goods from the victim to the account under the name of the Defendant.

Accordingly, the defendant was given property by deceiving the victim.

[2013 Highest 1310] On September 22, 2013, the Defendant reported an advertisement posted by the victim F on the Internet Nurier's website, and made a false statement that “I will send the things if you send KRW 250,000.”

However, the defendant did not have the intention or ability to sell the wheelchairs of the above vehicle.
