1. The summary of the grounds for appeal did not reveal the victim D, and even though there was no participation in assault against the victim E, the court below convicted all the facts charged of this case on the sole basis of the victim's statement. The court below erred by misapprehending the facts, thereby affecting the conclusion of the judgment.

2. The following circumstances acknowledged by the evidence duly adopted and examined by the court below, i.e., (1) the victim D left the front of the cargo loaded at around 18:00 on December 7, 201 with A and Si expenses.
