Defendant shall be punished by a fine of KRW 4,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. The Defendant of forging a private document or uttering of a falsified private document indicated in B on the advertisement “to enable the acquisition of Korean driver’s license,” and had the mind to request the “C” to manufacture a driver’s license.

On April 2018, the Defendant decided to pay KRW 80,00 to C, and requested the production of the Defendant’s Vietnam Driver’s License, and sent the certificate of foreigner registration, passport, and the confirmation of entry into and departure from Korea, etc., after photographing the documents transmitted as above, C sent the documents so transmitted to the person in default of name in Vietnam, and the person in default of name made a fake driver’s license under the name of the transportation station in Vietnam and delivered it to C through C.

On May 14, 2018, the Defendant continued to submit to the staff in charge of issuing a foreign license, who is aware of forgery at the Gangseo-gu Seoul Metropolitan City driver's license test site, along with an application for the exchange of driver's licenses, as if the above completed the above service with respect to the forged Defendant.

Accordingly, the Defendant, in collusion with C, forged a driver's license in the name of the Vietnam Transportation Bureau against the Defendant, which is a private document about a certificate of fact, and exercised it for the purpose of uttering.

2. On May 14, 2018, the Defendant of the obstruction of performance of official duties by fraudulent means presented to the employee in charge of issuing a foreign driver’s license under his/her name undissatisfy in the driver’s license test site, along with an application form for the exchange of a foreign driver’s license, as described in paragraph (1), as if he/she had a legitimate Vietnam driver’s license, and was issued a domestic driver’s license by the said employee around that time.

Accordingly, the Defendant conspireds with C, etc. to perform the legitimate duties of the public official in charge of issuing driver's license.
