The prosecutor's appeal is dismissed.

1. According to the evidence submitted by the prosecutor, the court below erred by misapprehending the legal principles as to the facts charged, since the defendant could fully recognize the fact that the defendant inflicted an injury on the victim E by breaking the victim E's bridge as stated in the facts charged in this case.

2. The following circumstances acknowledged by the evidence duly adopted and examined in the judgment of the court below, i.e., witness G, stated that the defendant exceeded the victim's bridge as stated in the facts charged in this case, but this is contrary to the victim's statement that the defendant was born his chest, and considering that the F, I, and H stated that the defendant was unable to be deemed to damage the victim's bridge at the time, it is insufficient to recognize the facts charged in this case's statement alone. Thus, the court below's judgment of not guilty as to this part of the facts charged on the grounds as stated in its reasoning is justified.

3. Accordingly, according to the conclusion, the prosecutor’s appeal is dismissed pursuant to Article 364(4) of the Criminal Procedure Act. It is so decided as per Disposition.
