1. As to the Plaintiff KRW 808,466,37 and KRW 350,00 among them, the Defendant shall pay to the Plaintiff KRW 458,466,337 from August 20, 2016, and KRW 458,46,337.
Reasons
1. Basic facts
A. The plaintiff is an autonomous management organization organized by occupants to manage A 12-dong apartment buildings located in Mapo-gu Seoul Metropolitan Government (hereinafter "the apartment of this case"), and the defendant is a project undertaker who sold the apartment of this case.
B. The instant apartment was inspected on October 11, 2006 for the pre-use inspection and the repair of defects of the instant apartment.
The apartment building of this case did not construct the part to be constructed in accordance with the design drawing during the new construction process, or revised differently from the design drawing and constructed in a defective manner or differently from the design drawing, resulting in a defect such as rupture and water leakage in the section for common use and the section for exclusive use. Therefore, even though the Plaintiff requested the repair of defects from March 29, 2007 to the Defendant, there still remain such defects as described in attached Table 1, 1, 2, and 2, and 2, in the apartment of this case, the total sum sheet of the repair cost is as described below.
