1. Basic facts

A. On November 24, 2005, the Plaintiff remitted KRW 40,000,00 to the Defendant’s account under the name of the Defendant. On December 5, 2005, the Defendant drafted to the Plaintiff a written contract with the following contents (hereinafter “instant contract”).

계약서 일금 四千萬원(40,000,000원) 상기 금액을 2005년 11월 24일 A이가 B(D은행 계좌번호 E)에게 부송하고 B는 상기 금액을 받은 것을 확인 인정하였음. 상기 금액은 B가 다른 금융기관보다 높은 금리로 차용하여 A에게 지불키로 서약함. 년 금리 400% 이상임. 상기금액을 하시라도 청구할 시에는 아무 조건 없이 B는 A에게 원금과 이식을 지불키로 서약합니다.

D. On October 16, 2008, the plaintiff delivered KRW 500,000 to the defendant in cash, and the defendant prepared a confirmation certificate as follows to the plaintiff.

E. The Defendant filed a complaint with the Plaintiff for the alteration and display of a private document on the ground that “the Plaintiff altered the instant contract,” but the prosecutor in charge did not alter the private document on June 28, 2019.
