1. The defendant shall be the plaintiff.

A. To deliver the buildings listed in the annexed sheet;

B. KRW 39,350,000 and this shall be October 1, 2019.

Reasons

1. Basic facts

A. A. Around April 2006, the Plaintiff leased a building listed in the attached Form (hereinafter “instant store”) to the Defendant (hereinafter “instant store”) with a deposit of KRW 15 million, monthly rent of KRW 1,300,000 (after the 30th of each month), and the period of KRW 2 years.

(hereinafter referred to as the instant lease agreement). Around that time, the Defendant paid the Plaintiff the lease deposit of KRW 15 million to operate the term “C” by selling the instant store, and the instant lease agreement was renewed every two years.

B. On November 13, 2012, the Defendant drafted, prior to October 30, 2012, a promissory note with the purport that the Plaintiff will pay KRW 5 million to the Plaintiff the overdue rent not later than the date of arrears.

C. In 2013 and 2014, the Plaintiff reduced the monthly rent of the instant store to KRW 1.2 million.

On December 13, 2014, the Plaintiff leased the instant store to the Defendant by increasing the monthly rent of KRW 1.5 million.
