Defendants shall be punished by imprisonment for one year.
However, the defendants are above three years from the date of this judgment.
Reasons
Punishment of the crime
Defendant
A is the actual representative of the "J", which is a textile importer in Busan Metropolitan City I, and the representative of the "K" corporation, which is a U.S. corporation.
If it is intended to import goods, the name, size, quantity and price of the relevant goods, and other matters prescribed by Presidential Decree shall be reported to the head of a customs office, and no dutiable value, tariff rate, etc. shall be falsely reported or omitted to affect the determination
Nevertheless, if the Defendants conspired to export the original body from China to the United States, the Export Insurance Corporation in China used a system to pre-payment of the price of goods to the exporting company from China and then intended to import the original body at a low price in Korea.
Accordingly, Defendant B entered into an original import contract with the original company of China at 0.44 US dollars per meter in the name of the above U.S. corporation using the name of “K” corporation of the U.S. operated by oneself and “M” corporation of the U.S., and entered into the original import contract with the original company of China at 0.44 US dollars, and then exported the original form from China via the U.S. port at 0.12 US port to Korea, and Defendant A was in charge of importing and selling the physical color and the original body of Chinese original selling company to Korea.
On January 6, 2015, at the Daegu Customs Office, the Defendants also reported the import price of USD 495,838 from "M" to "M", a U.S. corporation, to the extent that the actual price of the above goods is USD 218,169, which was low as if it had been 59,501, and subsequently evaded customs duties equivalent to USD 14,085,02 equivalent to USD 158,668, which is the difference in the raw materials cost, and from January 6, 2015 to March 10, 2015 by the same method nine times in total as shown in the attached list of crimes.
