Of the instant lawsuits, the part of the plaintiffs' claims against Defendant Seoul Special Metropolitan City and D and Defendant E.

1. Basic facts

A. On January 25, 1964, Dongdong-gu Seoul on the purchase of H Large 3,749 square meters and completed the registration of ownership transfer on the 27th of the same month. On May 8, 1965, Dongdong-gu on the ground of H land of this case (hereinafter “instant building”).

A new construction was conducted. After that, Seongdong-gu Seoul Metropolitan Government H Dae-dae 3,749 square meters, the area was reduced to 1,134 square meters due to the expropriation of 791 square meters for the construction of roads on July 13, 1968 (hereinafter “H land”).

(2) Defendant E Co., Ltd. (Co., Ltd. I) (Co., Ltd.) changed the trade name to Kro Co., Ltd. on July 1, 2004, July 1, 2005, and July 1, 2006, Defendant E Co., Ltd.; hereinafter “Defendant E”), regardless of whether it was before or after the mutual change, purchased the H land and buildings on July 31, 1987, and completed the registration of ownership transfer on August 10, 1987, by purchasing the H land and buildings on the land of this case, which are the owner of start-up business.

3) On December 15, 2005, the Plaintiffs purchased the instant H land and the instant building from Defendant E, and completed the registration of ownership transfer on the 29th of the same month for the Plaintiff A (the deceased head G), the Plaintiff B, and C (ASEAN)’s respective 25/74 shares. (4) On August 30, 1967, the Defendant completed the registration of ownership transfer on the grounds of land expropriation on August 26, 1967.

B. 1) The key part of the instant F land among the instant F land was used as part of the site of the instant building and as a parking lot. 2) Of the instant F land, the portion of the instant land was used as part of the instant building. 3, 13, 14, 15, 5, 4, and 3 square meters in sequence of each point of the attached Form (1) drawings, which are the remainder of the instant F land, are used as a road.

C. 1) On April 16, 1966, the N Project on Seongdong-gu Seoul, including the instant F land, was publicly announced L, which was publicly announced on April 16, 1966. 2) The Defendant purchased the instant F land from O on August 26, 1967 through land compensation procedures for N Project.
