A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 2017, the Defendant entered into a lease contract for the instant officetel at the “D” office operated by the Defendant located in the Dong-gu B Building C in Yongsan-gu, Seoyang-si, Seoyang-si at the request of the lessor, who is the owner of the building Ethypypypyp in Goyang-si, Goyang-si, Seoyang-si, Seoul, and at the request of the lessor, the owner of the building Ethypypyp in Goyang-si, Yangyang-si, the Defendant would deliver to the lessor the deposit amount of KRW 300,000,000 won to the victim.

“A false statement” was made.

However, in fact, the Defendant was requested by the said lessor to enter into a lease agreement of the said officetel on condition that 4.5 million won monthly deposit is paid by the said lessor, and was thought that 5 million won was paid to the lessor upon receiving the deposit from the victim and paid 5 million won to the lessor, and thus, there was no intention or ability to enter into a lease agreement of 30 million won or to deliver the full amount to the lessor, even if he received the money from the victim.

Nevertheless, on July 21, 2017, the Defendant received 30 million won as a deposit for lease from the injured party.

Accordingly, the defendant was given property by deceiving the victim.

2. Forging a private document;

A. On July 21, 2017, the Defendant stated in the column in which “office monthly rent contract” is located by using a computer without authority for the purpose of exercising the said office at the foregoing office of an authorized broker, the Defendant stated in the column in which the “office monthly rent contract” was located in the “Gonyang-si I in Gyeonggi-do,” and in the “Yon-si (Won 30,000,000) Won” and in the “Yon-gu (Won 30,000,000), three thousand won (Won 30,000),” and in the following column, the Defendant stated in the “G on July 21, 2017,” and stated in the “G” column as the “B on the 21st day of each month,” and then stored in the name of the said lessor in advance.

B. The defendant is using a computer without authority for the purpose of exercising it at the above date, time, and place.
