Punishment of the crime

Defendant

A is the representative member of the victim general partnership fund F in Ulsan-gun E from January 25, 1997 to October 2016, and Defendant B was each engaged in the decision-making on overall operation of the company, and Defendant B was engaged in the accounting duties as the member of the above company from March 5, 1997 to June 30, 2016.

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embezzlement);

A. On January 3, 2007, the Defendants conspired to make up for the occupational embezzlement under the pretext of provisional payment, and then embezzled total of KRW 2,725,000,000 for personal use from the new bank account (Account Number: H) in the name of the victim in the name of the representative member Eul to transfer KRW 90,000 from the new bank account (Account Number: H) in the name of the victim under the pretext of the provisional payment by the representative member Eul, and Defendant B made up for the said money, and Defendant B made up for the said money. From that time up to January 9, 2013, Defendant B embezzled up to January 1, 2013 in total of KRW 34 times, as indicated in Table 1 of the Crimes List.

B. On October 29, 2008, the Defendants conspired to make a false tax invoice from Defendant B as if they purchased “the covers for the dynamics” from Defendant B’s customer, and then withdrawn KRW 24,750,000 from the new bank account in the name of the victim as a check, and instruct Defendant B to deposit the said money to Defendant B’s post office account (Account Number:J) on the same day. Defendant B repaid the son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s her son’s son’s son’s her son’s son’s her son’s her son’s her son’s son’s her son’s her son’s her son’s her son’s her son.
