1. All of the plaintiff's claims are dismissed.

1. Facts of recognition;

A. Defendant B Co., Ltd. (hereinafter “Defendant Company”) is a company engaged in ready-mixed manufacturing business, etc. D is an internal director of the Defendant Company, and Defendant C (former name on April 24, 2008: E) is a D’s opinion substantially operating the Defendant Company.

B. From June 7, 2007 to April 23, 2008, the details that the Plaintiff paid money to the Defendants’ side are as follows (hereinafter “the attached Table 1”).

On June 7, 2007, the temporary amount of money (units: KRW 10,00,000) deposited into the account of F which is an infant of Defendant C on June 30, 2007, and deposited into the account of Defendant C on July 24, 2007, and deposited into the account of Defendant C on August 8, 2007; KRW 8,000,0000 on August 31, 2007; KRW 10,000,000 on deposit into the account of Defendant Company on September 10, 207; KRW 10,000,000 on deposit into the account of Defendant Company on September 30, 207; KRW 10,000,000 on deposit into the account of Defendant C on October 20, 207; KRW 10,000 on deposit into the account of Defendant C on September 10, 2008; and

C. From August 21, 2007 to November 6, 2009, the details that Defendant Company paid money to the Plaintiff or repaid in lieu of the Plaintiff’s debt are as follows (hereinafter “Attachment 2”).

On August 21, 2007, 1200 of the temporary amount of money (units: KRW 800,000) deposited from the account of the defendant company to the plaintiff's account on December 1, 2007, 3,000,000 above Dong 32, 40,000 above Dong 50,000 above April 21, 2008, 50, 500 above Dong 50, 900, 2000 above to the defendant company's account on August 25, 2008, 200 to the plaintiff's account on March 24, 200, 200 to the 10,0000 defendant company's account on June 10, 209, 2009 to the plaintiff's account on June 10, 200, 209 to the defendant company's account on June 9, 2009
