Reasons
Punishment of the crime
1. No person, other than an entrusted business entity, who commits a joint crime of Defendant A, B, C, D, E, F, or G and a national sports promotion corporation of the Seoul Olympic Games or an entrusted business entity, shall engage in any act of offering property or property benefits to persons who correctly predicted the outcome by issuing voting rights for sports promotion or any similar things, and no person shall establish a space for gambling for profit;
Nevertheless, the Defendants, along with S, T, U,V, W, X, Y, Z, etc., opened “A”, “AB”, “AC,” etc., which is an illegal sports soil site, and subsequently recruited in order to have the profits divided according to their respective roles.
Accordingly, S and T, as an operator of the above gambling site, are in charge of overall affairs related to the operation of the gambling site, such as management of accounts, profit distribution, membership management, and gambling advertising, etc., U, as an account recruitment book for the above gambling site, shall recruit an account to be used in the operation of the gambling site, and V, W, and X shall withdraw cash from the gambling account as a cash withdrawal book and deliver it to S and T. Defendant A shall be in charge of filling, exchanging, exchanging, and customer counseling with gambling users, Defendant B, Defendant C, Defendant D, Defendant E, and Defendant E shall receive 25% or 40% of the profits generated from members collected in return for recruiting members of the gambling site from T, and shall take charge of the above total amount of money and money exchange and game filling.
